I would talk to JAG about your question. I honestly am not sure. If you are not yet divorced or drew seperation papers I am sure in the eyes of many you are married so yes HE would still get BAH for the dependant rate.

talk to JAG or find a lawyer ASAP. Until divorce papers are signed you are still a dependent and he is getting paid accordingly

HE is still getting the money. Until a divorce is finalized, he gets the money, now if he wants to share that BAH with you or not, is up to him, unfortunately it goes to his bank account, not yours. Unless you guys share a bank account...

My friend is seperated and workign on getting a divorce and he's AD Army and he gets a bah at a dependent rate but he doesn't give anything to his "wife". I guess you could get a lawyer and fight for it but I don't know how that all works. Deffinately talk to the JAG office though
